PocketForge Terms of Service

These Terms of Service (“Terms”) govern your use of the PocketForge mobile application (“App”) provided by WeaveHub Technologies LLC (“WeaveHub,” “we,” “us,” or “our”). By downloading, installing, or using PocketForge, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Service Description

PocketForge is an iOS client application that provides a unified interface for monitoring and managing VMware vSphere, Nutanix Prism, and Proxmox hypervisor environments. The App connects directly from your device to your own servers using credentials you supply and store locally on your device. WeaveHub does not host, proxy, or intermediate your infrastructure data.

PocketForge is a management tool for IT professionals. It facilitates your interaction with your own hypervisor infrastructure but does not itself provide hosting, virtualization, or infrastructure services.

2. Eligibility

PocketForge is designed for IT professionals and system administrators. You must be at least 18 years of age to use PocketForge. By using the App, you represent that you meet this requirement and that you have the legal authority to agree to these Terms. If you are using PocketForge on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Subscription and Payment

3.1 Free Trial

New users may be eligible for a 7-day free trial. The trial requires Sign in with Apple for identity verification. Trial eligibility is limited to one trial per Apple account, enforced server-side through the WeaveHub licensing server. Any unused portion of the free trial period will be forfeited upon purchasing a subscription.

3.2 Subscription Terms

PocketForge is available as a paid auto-renewable subscription through the Apple App Store. The subscription price and billing period are displayed in the App Store at the time of purchase. Payment will be charged to your Apple ID account at confirmation of purchase.

3.3 Renewal and Cancellation

Your subscription automatically renews unless it is canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. You can manage and cancel your subscriptions by going to Settings > [Your Name] > Subscriptions on your Apple device. Cancellation takes effect at the end of the current paid period.

3.4 Access Restriction

When your subscription lapses and no active trial is available, access to PocketForge’s premium features will be restricted until a subscription is purchased or renewed.

3.5 Refunds

All payments are processed by Apple. Refund requests must be directed to Apple in accordance with Apple’s refund policies. WeaveHub does not process payments directly and cannot issue refunds.

4. Your Responsibilities

4.1 Authorized Access

You are solely responsible for ensuring that you have proper authorization to access and manage the hypervisor infrastructure you connect to through PocketForge. You must have valid credentials and administrative permission from the infrastructure owner before performing any operations.

4.2 Credential Security

You are responsible for the security and validity of the server credentials you configure in PocketForge. Credentials are stored locally in the iOS Keychain on your device. WeaveHub has no access to your credentials.

4.3 Management Actions

PocketForge enables you to perform management actions on your infrastructure, including VM power operations (start, stop, restart, suspend), resource management, and host operations. You are solely responsible for all actions taken through PocketForge and their consequences on your infrastructure. WeaveHub is not liable for any service disruption, data loss, or infrastructure damage resulting from management actions initiated through the App.

4.4 Self-Signed Certificates

Many hypervisor environments use self-signed TLS certificates. PocketForge allows you to connect to servers using self-signed certificates. By choosing to connect to a server with a self-signed certificate, you acknowledge the associated security considerations and accept responsibility for verifying the server’s identity.

5. Intellectual Property

PocketForge, including its design, code, graphics, logos, and documentation, is the property of WeaveHub Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

“PocketForge” and “WeaveHub” are trademarks of WeaveHub Technologies LLC. VMware, vSphere, and vCenter are trademarks of Broadcom Inc. Nutanix and Prism are trademarks of Nutanix, Inc. Proxmox is a trademark of Proxmox Server Solutions GmbH. These third-party trademarks are the property of their respective owners. PocketForge is an independent product and is not endorsed by, affiliated with, or sponsored by any of these companies.

6. Disclaimer of Warranties

POCKETFORGE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WEAVEHUB DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WEAVEHUB DOES NOT WARRANT THAT POCKETFORGE WILL BE COMPATIBLE WITH ALL HYPERVISOR VERSIONS, CONFIGURATIONS, OR ENVIRONMENTS. COMPATIBILITY MAY VARY BASED ON API VERSIONS, NETWORK CONFIGURATIONS, AND PLATFORM-SPECIFIC FEATURES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEAVEHUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF POCKETFORGE.

WEAVEHUB IS NOT LIABLE FOR ANY INFRASTRUCTURE DAMAGE, SERVICE DISRUPTION, DATA LOSS, OR SECURITY INCIDENTS RESULTING FROM MANAGEMENT ACTIONS INITIATED THROUGH POCKETFORGE OR FROM CONNECTING TO SERVERS WITH SELF-SIGNED CERTIFICATES.

IN NO EVENT SHALL WEAVEHUB’S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO WEAVEHUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

8. Apple-Specific Terms

You acknowledge that these Terms are between you and WeaveHub Technologies LLC, not with Apple Inc. (“Apple”). WeaveHub, not Apple, is solely responsible for PocketForge and its content.

The license granted to you for PocketForge is limited to a non-transferable license to use PocketForge on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Apple has no obligation to provide maintenance or support services for PocketForge.

In the event of any failure of PocketForge to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to PocketForge.

Apple is not responsible for addressing any claims by you or any third party relating to PocketForge or your possession and use of PocketForge, including but not limited to: (i) product liability claims; (ii) any claim that PocketForge fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that PocketForge or your possession and use of PocketForge infringes that third party’s intellectual property rights, WeaveHub, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Indemnification

You agree to indemnify, defend, and hold harmless WeaveHub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of PocketForge, your violation of these Terms, actions taken on your infrastructure through the App, or your violation of any third-party rights.

10. Termination

You may stop using PocketForge at any time by uninstalling the App and canceling any active subscription through your Apple ID account settings. We reserve the right to suspend or revoke your license to use PocketForge if we reasonably believe you are violating these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of laws principles.

12. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date and, where practicable, through an in-app notice. Your continued use of PocketForge after changes take effect constitutes acceptance of the revised Terms.

13. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeaveHub regarding PocketForge.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms. WeaveHub may assign its rights and obligations without restriction.
